NJ Realty Rental Listing Legal Agreement

Please read our legal agreement below before listing your property for rent

Legal Agreement
Before we can rent your property, you must read and agree to the terms:

NJ Realty Sea Isle City, INC., herein known as Agent, is hereby authorized by the Owner or Owners to obtain tenants for the property further described on the reverse side of this agreement for the dates and at the rates detailed on the reverse side of this agreement. The undersigned represent that he/she has a legal right to authorize the Agent to obtain tenants for the above property.

  1. Owner shall maintain the property(s) in clean and presentable condition prior to occupancy and insure that all appliances and utilities are in working order and to provide a fully equipped kitchen adequate to accommodate the number of persons permitted to occupy the property.
  2. Owner shall immediately notify Agent of any change in availability of the property. Call 1-800-648-9316 anytime or email change to info@njrealtysic.com
  3. Damage deposits, if applicable, shall be held by NJ REALTY. Damage deposits cannot be held for cleaning issues. NJ Real Estate Law describes the cleaning of the premises as the landlord's responsibility. Failure by a tenant to adequately clean a unit is considered "normal wear and tear". If Owner has a claim against said deposit, Owner must inform Agent IN WRITING within 7 days after the lease termination date. If Agent receives no claim from Owner within 7 days after the lease termination date, Owner hereby authorizes Agent to return said deposit to tenant.
  4. Agent shall forward rent deposits to Owner prior to the commencement of a rental term when possible, after receiving a fully executed lease. Prior to forwarding rental deposits, Agent will deduct and retain Agent's commission as outlined herein. No payment will be made to the Owner on personal checks which have not had sufficient time to clear the Agent's bank.
  5. Agent will NOT be responsible for any tenant's damage, conduct, negligence, violation of local or state laws, or the fulfillment or non-fulfillment of any of the terms of any lease agreement by either the tenant or the Owner. Agent is not required to mediate a dispute between landlord and tenant regarding damages.
  6. Agent's commission is 10% of the gross rental collected by the Agent on behalf of the Owner. Gross rental includes rent but does not include damage deposits. Agent's commission is considered earned upon the receipt of the deposit by the Agent. If within (2) years the Owner should rent or sell to any person who is a party to a lease covered under the term of this agreement, the Owner shall pay the Agent a full commission on that sale or lease and each subsequent renewal.
  7. EXCLUSIVE LISTING. As exclusive rental Agent, the owner assigns the Agent the sole and exclusive right to rent the property(s) during the term of this agreement. This sole and exclusive right shall extend to permit the Agent to execute a lease on behalf of the Owner pursuant to the terms and conditions of this agreement.
  8. NON-EXCLUSIVE LISTING. We would prefer to represent you exclusively, but if you do list with other agents it is absolutely necessary that we are advised of their names. This will eliminate duplicate rentals. Please make sure you select all agencies that rent your property.

You have the right to individually reach an agreement on any fee, commission, or other valuable consideration with any broker. No fee, commission, or other consideration has been fixed by any governmental authority or by any trade association or multiple listing service. Nothing herein is intended to prohibit an individual broker from independently establishing a policy regarding the amount of fee, commission, or other valuable consideration to be charged in transactions by the broker.
